The Trademark Application Process
After Trademarkify files your trademark application, your application will be examined by a trademarks examiner before it can be registered.
Trademark Examination
Your trade mark application will typically be examined four months from when we file your trademark application.
During examination your trademark application will be examined to determine whether your trademark is registerable. The trademark examiner will check various things, such as whether your trademark application is capable of distinguishing and whether your trademark is the same or similar to any existing trademarks or trademark applications in the same or similar goods and services.
If your trademark application is deemed suitable for registration by the trademarks examiner, your trade mark will be accepted for registration. However, if there are any problems with your trademark application, the trademarks examiner will issue an examination report providing you with the opportunity to correct any issues. You must reply in writing to the examination report and a Trademarkify registered Australian trademarks Attorney can assist in responding to the examiner on your behalf of you wish.
You have 15 months from the date of the examiner's first report, to have your trademark application accepted. Extensions of time are however available by paying an extension of time fee.Trademark Oppositions
Once your trademark application has been accepted for registration, any person may oppose the registration of your trademark. Such a person may be a competitor or some who believes that your application is confusingly similar to their trademark, for example.
Trademark Registration
If no opposition is filed against your trademark application your trade mark will be registered in the trademarks register for all to see. You must also pay a government registration fee of $250 per class.
Trademark Renewals
Your trademark offers protection for ten years. However, this ten year period may be reviewed indefinitely by paying a renewal fee.
