The trademark registration process often leads to cost blowout. During examination, the examiner may raise an adverse examination report, such as where the examiner believes that a trademark application conflicts with an earlier filed trademark, or that the trademark application is too descriptive of the nominated goods and services.
In addressing the issues raised by the examiner, one must respond formally by way of responses to the adverse examination report. This is where most trademark attorneys make the bulk of their fees, wherein cost can oftentimes blowout to three times the initially anticipated cost.
Furthermore, it may take 6 to 11 weeks for an adverse examination report to issue, but which time branding, domain and company registration and the like may already have been undertaken.
