During the 3 point Trademark Attorney Registerability Review a trademark Attorney will review three aspects relating to the registerability of your trademark:
Check 1 - Capable of distinguishing
Your trademark must be capable of distinguishing. In other words, if your trademark describes your goods or services, the trademark comprises a sign that other traders are likely to use in the course of their business.
During this step, a trademark Attorney will advise on whether your trademark is capable of distinguishing and suggest amendments to your mark if necessary.
Check 2 - Conflicting with other marks
If your trademark is the same or similar to other live trademarks in the trademarks register for the same or similar goods and services, your trademark may be rejected.
During this step, a trademark Attorney will perform a supplemental trademark (in addition to the search already conducted by the Trademarkify filing software) search to identify any potentially conflicting trademarks and suggest amendments to your mark if necessary.
Check 3 - Scope of goods and services
Trademarks are registered in respect of one or more goods and services. The more goods and services, the greater the scope of protection. However, the more goods and services, the greater the chance of your trademark conflicting with other trademarks during examination.
